Baku / 10.09.18 / Turan: The chairman of the REAL party Ilgar Mammadov appealed to Prosecutor General Zakir Garalov with a demand to initiate criminal cases against judges who executed the "order" against him.

Mammadov was sentenced to 7 years in prison on charges of organizing mass riots in the town of Ismayilli in January 2013.

The European Court of Human Rights (ECtHR) in May 2014 recognized the violation of Mammadov's rights to freedom and the presumption of innocence. In addition, the ECtHR found a violation of Article 18 of the European Convention, that is, political motives for persecuting the leader of REAL.

In autumn 2017, the ECtHR also found the sentence on Mammadov unlawful.

On December 5, the Committee of Ministers of the Council of Europe decided to launch a special procedure against Azerbaijan in connection with the failure to comply with the ECtHR judgments in this case.

On August 13 this year, Mammadov was released on probation with a probation period of 2 years.

"The ECtHR's decision, which entered into force on October 13, 2014, notes that the main goal of the February 4, 2013 and subsequent decisions on the arrest of Mammadov was "to punish or silence me," Mammadov wrote to the Prosecutor General.

He believes the judges intentionally restricted his freedom. "Article 295 of the Criminal Code recognizes deliberate sentencing, ruling and determination as a crime and provides punishment for this.

According to Article 204.1 of the Criminal Procedure Code, individuals may have information about a committed or prepared crime in writing or verbally. Articles 207-2013 of the Criminal Code define the rules for starting a criminal case on the basis of such information.

Being an individual and guided by the above, I inform you in writing: criminal acts have been committed against me and as a result I consider myself to be a victim. The adoption of appropriate steps to identify those who participated in this crime is required by Azerbaijani legislation," Mammadov further notes.

Earlier, he stated that 19 judges considered his cases and their decisions were not recognized as lawful by the ECtHR. Mammadov said he will fight to the end to punish these judges.

The Prosecutor General's Office and other state departments have not yet reacted to Mammadov's appeal. -03D-
