Lawyer Asabali Mustafayev: the court case against me is connected with the ases I won in the ECHR

The lawyer Asabali Mustafayev was summoned tody to the  Sumgayit city court in connection with the tax claims against him. It  almost coincided with the announcement  of 13 judgments of the European Court of Human Rights (ECtHR) on the complaints from Azerbaijan, the defender in which was Mustafayev, who is also the head of the NGO "Resource Center for Democracy and Human Rights." On his page on Facebook Mustafayev wrote  that the  Ministry of Taxes has acted with the idea to a ban  the lawyer leaving the country.

"I asked them how could they  impose a ban on non-existing rulet. For the past two years as a result of the ban in the general prosecutor's office, I can not leave the country. They imposed on me 8000 AZN additional tax. Allegedly  the NGO  led  by me did not register  2 or 3 grants, although the information on the registration of grants was placed n the website of the of the Ministry of Justice. I immediately challenged in court the application of the additional tax. But the court suspended the  proceedings in the case at the request of the Ministry of Taxes. And the pretext was that the investigation is continuing in the prosecutor's office, wrote  the lawyer.

He also reported that his claims about the illegality of the investigation the Attorney General, the ban on his leaving the country, the freezing of bank accounts are not considered, because the prosecutor does not come to court hearings.

"The absurdity is that on account of the organization is the sum  which is sufficient for the payment of additional taxes, but the tax authorities do not remove the money due to the fact that the prosecution has arrested it. The prosecutor's office does not allow to make a patment, and punished me. Most interesting is that in the case of the European Court on the complaint of Rasul Jafarov similar additional levy tax was found  unlawful. But  the prosecutor offiec, the court, and  tax office  do not take this into account ," Mustafayev said.

A hearing appointed for  July 1 was  postponed to July 8.

"Probably an idea of ​​the tax authorities will be satisfied, and I probably will not be allowed to leave the country.  Perhaps the court will make me pay for  electricity, water, sewer and other services, " sarcastically Mustafayev said.

He believes that the current  summon to the  court is an echo of yesterday's announcement  of the  decisions of the  ECHR on 13 cases of Azerbaijan  which he  defemded.

Total ECHR still upheld the complaint on 71 cases in which the legal representative  was Mustafayev. Only this year, the European Court adopted 22 decisions on matters in which he was a lawyer.

Total Mustafayev has prepared a complaint to the ECHR 297. Currently, 81 out of communication are completed,  on one has started communication.

The NGO "Resource Centre for Democracy and Human Rights" headed by him  for two years is  now under investigation on the so-called criminal case against local and foreign NGO.-03B-
