Ministry of Emergency Situations Received Mandate to Stop Construction and Demolish Buildings
President Ilham Aliyev on May 22 approved the rules on the suspension of construction and demolition of sites. These regulations define the powers of Emergency Situations Ministry in these matters.
Thus, construction may be suspended if a discrepancy is revealed with the design of the architectural planning, or there are deficiencies threatening the security of the building, or materials without quality certificates are used, etc.
The decision to suspend construction of the building is taken by the inspectorate of MOE.
Construction sites can be pulled down also, if they are built not in the right place allocated by the executive authority or by the municipality, or if the construction is carried out without permission.
The decision to demolish is taken by the State Agency for Supervision over Safety in Construction at MOE. The demolition should be done at the expense of the customer of the building. In the case of obstruction of the demolition, police force can be involved.
In cases where the side walls and roof of the object are fully constructed, MOE should go to court to obtain a permit for the demolition. -06D-
