The Shirvan Court of Appeal considered the suit of people affected by the floods in 2010 against the Ministry of Emergency Situations (MOE) today. In general, the complaints were about non-payment of cash compensation and non-execution by MOE of the government's orders for the restoration and construction of housing.
As in the previous case (on the complaint of another group of victims last week), the representatives of the Ministry of Emergency Situations did not come to the court. The court ordered the MOE for 15 days to respond to citizens' complaints.
The litigation resumed in Shirvan after a six-month break. In early spring, it was decided to move the trial from Baku to Shirvan, allegedly in order to facilitate the participation of the plaintiffs in the court.
In fact, the authorities delayed the conduct of the trials, which were held in Baku Administrative Economic Court nom.1 - at the location of MOE.
Over 130 lawsuits were filed against MOE and the government in the fall of 2010, but less than 10 of those found decisions. A part of them was granted or denied. Two claims are considered by the European Court of Human Rights.
The rights of victims in the court are defended by the Coordinator of the Kura Staf, Oktay Gyulalyev and the lawyer Fariz Gasimov.
In the spring of 2010 low-lying areas of the country were affected by flooding. The flooded area covered eight regions, ??over 100,000 hectares, and more than 20 thousand homes. To eliminate the effects of the flooding the government allocated about 500 mln AZN, but the tasks were not fully met. The elimination of the consequences of the flood is accompanied by rampant corruption, embezzlement, and massive violation of human rights. -0 -
