Pilot Project Canceled, Illegal Court Decisions Remain
Baku / 21.12.19 / Turan: The Cabinet of Ministers canceled on December 18 its decision N86 of February 25, 2016 on the demolition of residential buildings in Baku and the construction of new residential buildings in their place ("pilot project"). The decision talked about accelerating the socio-economic development of Sabail, Sabunchi, Khatai, Khazar, Binagadi, Surahany, Nizami, Yasamal, Garadag, Khatai, Pirallahi, and Nasimi districts of Baku.https: //cabmin.gov.az/az/docu / 4141/
The 86th decision caused a lot of complaints from citizens of the capital who did not want to be evicted from their apartments, did not agree with the amount of compensation, or did not believe in the decency of construction companies.
In the canceled decision, the district authorities retained the right to choose a developer, which gave residents grounds to not believe in the legality of the selection and to doubt the ability of the construction company to erect a new building on a contractual basis. In particular, residents of the Sabail settlement in the Sabail district of Baku examined the history of Sabah Residence, the developer company imposed by the executive branch, and found that the company had previously lost a lawsuit in a similar lawsuit by residents in another district of the capital, and there were not enough funds in the company's authorized capital.
The Turan news agency reported that residents of the apartment building at Baku, Sabail district, 8 Alibey Huseynzadeh Street, addressed the “last open letter” to the President of Azerbaijan. They reported that they repeatedly sent letters to the President and First Vice President, but their appeals remained unanswered. The citizens reported on the arbitrariness of the construction company Qala Group and the company Sabah Residence, which it created, which, using Cabinet Resolution No. 86 of 02.25.2016, force tenants to leave their privatized apartments.

“The ill-fated resolution of the Cabinet of Ministers No. 86 of 02.25.2016 was annulled. Only those construction companies that managed to do something before August 1, 2018, can finish work in the same way. The pilot project is closed. Despite this, court decisions to evict residents and declare their homes in emergency remained in force. The question remains unresolved: What to do with the court decisions? No one has canceled them,” said Viktor Sapunkov, a resident of the house that fell under the Pilot Project, commenting on what is happening.
One of the reasons for the cancellation of the 86th decision of the Cabinet of Ministers may be the collective complaints of Baku People to the European Court of Human Rights, in which the residents referred to the first article of Protocol No. 1 to the European Convention for the Protection of Human Rights and Fundamental Freedoms, to which the Republic of Azerbaijan is a party. This document speaks about the right of people to own property and state protection of this right.
