Prosecutor Asks to Sentence Journalist to 3.5 Years
The Nizami district court has completed the trial of the journalist and activist Elchin Hasanov, accused of hooliganism. Today, the prosecutor suggested sentencing him to 3.5 years in prison.
This stemmed from an incident a year ago, when Hasanov was attacked by the former head of the agency Asia Jafar Jafarov. Jafarov is now on trial on charges of extortion.
After the incident, Hasanov appealed to the police and after some time Jafarov was arrested by the General Directorate for Combating Organized Crime, not on the complaint from Hasanov, but in connection with extortion.
However, in March of this year on this fact against the very Hasanov a criminal case was filed under article 221.1 (hooliganism) of the Criminal Code. After Hasanov informed the press about it, the charge of hooliganism was changed to a heavier article 221.3 (hooliganism with the use of bladed weapons).
Commenting this situation for Turan, the lawyer Fariz Namazly called the accusation absolutely devoid of legal basis.
"In fact there are no witnesses to the incident. The investigation did not establish how specifically "blunt" was the object, with which Hasanov allegedly stabbed Jafarov. Jafarov himself also said he did not see what was in Hasanov’s hands and he has no claim to him. The expert who gave the opinion on Jafarov’s injuries stated in court that these injuries could be the result of punching, scratching with a fingernail or a fall. That is, the expert has not confirmed to the investigators about any striking sharp object," said the lawyer.
The final speech of the defense is scheduled for 10:30 on May 18. The lawyer will ask the court to justify Hasanov.
Hasanov himself is under a signed promise about not departure. He was also taken a signed promise not to divulge the investigation materials.
