Sabah Residence destroys the house in which people live

On March 15, the Economic Court will consider the claim of seven residents of a three-story apartment building in the Bayil massif of Baku, accusing the construction company Sabah Residence of illegally destroying their immovable property. The house at 10 Khanlar str., has gradually, by the efforts of this company, turned into a construction garbage, in which people try to live.

The house is surrounded by a fence, as if it were uninhabited. Some apartments have been completely destroyed, and how to live in them if the communal communications in the neighboring apartments are intentionally damaged by the builders? Moreover, Dmitry Lugansky, a resident of this area, told Turan that his property was taken out of the apartment destroyed on February 2 and hid, and they will be given back in exchange for a written commitment to accept the terms of the company, and recognize that nothing has been stolen or damaged.

"This is blackmail, they force us to agree with the terms of the company, the owners of which cannot present their constituent documents to residents. Representatives of the company show only the contract with the Sabail District Executive Power for the construction of a new house according to the "pilot project", and show the plan of this house, under which there are no seals and signatures. The state does not guarantee that the company will leave us without housing, on the street, when the issue of money for the temporary apartment will be stopped," Lugansky said.

It is declared that the house is in a state of emergency, and therefore falls under the requirements of the "Pilot Project", it means it will be demolished regardless of the will of its owners," Sabah Residence announced. In response to the complaint of Svetlana Seidaliyeva, the head of the economic department of the district Executive Power, Vugar Mammadov, officially announced in December 2017 that the house in Khanlar street, 10, was inspected by the Ministry of Emergency Situations and falls under the definition "emergency". But the tenants looked at the standards for determining the accident rate of buildings, and found that the Ministry of Emergency Situations was acting in violation of its own norms, therefore, the conclusion about the accident rate is untenable," Lugansky stressed.

Last year, tenants were tortured by Gala Group MTK, but for unknown reasons, instead of the Gala Group, the executive authority hired Sabah Residence. Residents of the house want to know the history of this company and the reason for the "change of owners", as they are afraid to be one-on-one with rogue impostors, who destroyed their apartments and did not build a new house. But there is no information about the construction company, although the site is available - rather an advertisement than an information one.

Meeting in February with the residents of the house, the head of the Executive Power of the district, Eldar Azizov, advised them to be careful when signing the contract with the company, since by signing this document, they will be left alone with Sabah Resident. That is, if the company deceives - the regional authorities will not help the Baku people. Asked by Lugansky about the reason for signing an executive contract with this firm, Azizov said that it had won the tender. But the documentary evidence of the tender was not presented to the tenants, the company's website does not say about the tender either.

Lugansky and other residents of the house are suing the company, which is destroying the apartments and selling the plastic frames taken from them. Residents do not believe in the company's proposal to provide them with a new apartment with an expanded area instead of the old one, and that the company will pay 300-350 manat for a temporary lease. They also do not agree with the proposal to take money at the rate of 1500 manat per square meter of the old apartment. Lugansky is not offered money any more, the company, probably, believes that left without an apartment he will agree to wait for the new apartment to be built for an unknown number of years.

Tenants have won the first court in the Yasamal district, the court decided to stop the destruction of the house. But Sabah Residence filed an appeal, and the next two courts took the side of the company. Builders are also protected by the local police and prosecutors. No lawsuit has been filed on the fact of the destruction of the apartments and the property of Lugansk in them, despite the fact that the property is private, and the owners have not refused it.

On March 2, 2018, the residents of this house Rufat Ismailov, Rufat Salimov, and Kamal Alekperoglu addressed the district prosecutor N.Askerov in writing, reporting on the method of Sabah Residence pressure on residents who did not want to sign a dubious agreement. Workers break down the apartments of the neighbors who leave the house, the house"s roof was demolished, water, gas, sewage services stop running; suspicious people are running into the courtyard, threatening to leave the tenants without housing, as it happened with their neighbor Lugansky, residents reported. But the prosecutor's office redirected the complaint of Ismailov and others ... to the district Executive Power covering the construction company! In another letter (from 02.03.18) the prosecutor's office suggested that Lugansky go to court.

"As if we live not in the state, but in a society of lawlessness and violence. Where can we go if the authorities do not react, offering agree with the builder's requirement, and law enforcement structures protect not people < but the company? Should we ask for protection in embassies of other states?" asks Lugansky.

The site of the construction company http://www.sabahresidence.az placed a photo of an imposing multi-storey building, which is planned to be built on the site of the demolished house along the street, Khanlar 10. The neighboring houses will be demolished, as the company intends to change the appearance of the whole block.
