Baku / 13.09.18 / Turan: The situation with the Institute of Advocacy in Azerbaijan was discussed in Warsaw with the organization of the Institute of Human Rights of the International Bar Association.

On September 12, lawyers, lawyers from Russia, Kazakhstan, Tajikistan, Belarus, the official representatives of the Paris Bar Association, as well as from countries located in the OSCE area participated in the discussions at the annual OSCE conference on human rights and democracy in Warsaw.

During the discussions, the speech of the independent lawyer Nijat Mammadbayli on the status of advocacy in Azerbaijan was heard.

He recalled that in 2017 amendments were made to legislation related to the Bar. According to the changes, the activity of the institution of representation was limited. Non-members of the Bar Association cannot protect the rights of citizens in the courts. Azerbaijan has the lowest level of lawyers per person.

The issue of attacks and pressure on lawyers, coming out on political processes, and their expulsion from the Bar was also discussed.

Mammadbayli said that about 10 lawyers in Azerbaijan, without any legal basis, on the basis of the appeal of the prosecutor's office were excluded from the Bar.

According to him, the punished lawyers defended the rights of people arrested for political reasons and declared "political prisoners" by human rights organizations.

Mammadbayli noted the existence of problems with the Code of Ethical Conduct of Lawyers, and there is a restriction on freedom of expression of lawyers. The conference continued to discuss ways to improve the situation of lawyers.

There are 1,500 attorneys in Azerbaijan. Over the past 7 months, many lawyers have been suspended. Among them, there are Yalchin Imanov, Asabali Mustafayev, Neymat Kerimli, and Fakhraddin Mehdiyev. With the exception of Yalchin Imanov, the activities of the remaining lawyers have been suspended for a period of one year. -0-
