Supreme Court to Consider Appeal from Intigam Aliyev January 26
Azerbaijani Supreme Court on January 26 is to consider an appeal from the human rights defender Intigam Aliyev. In the case of rejection of the complaint the defense intends to appeal to the European Court of Human Rights.
Intigam Aliyev was arrested on August 8, 2014. He was charged under Articles 213.1 (tax evasion), 308.2 (abuse of power), 192.2 (illegal entrepreneurship) and 179.3.2 (misappropriation and embezzlement) of the Criminal Code.
On April 22, 2015 the Baku Court of Grave Crimes sentenced Aliyev to 7.5 years in prison. On July 21 the Baku Court of Appeal upheld the verdict.
As the lawyer Shahla Humbatova told Turan, examination of the appeal Aliyev is scheduled for 26 January, chaired by a judge of the Supreme Court Gulzar Rzayeva.
The defense intends to seek justification for Intigam Aliyev. In the case of rejection of the complaint, the lawyers will appeal to the European Court of Human Rights (ECHR).
Earlier, the lawyers appealed to the ECHR against the illegality of the arrest of Intigam Aliyev and inhuman treatment of him. The ECHR concluded the communication on the complaint of the violation of Aliyev’s rights guaranteed by Articles 3 (prohibition of torture) and 5 (right to liberty and security) of the European Convention on Human Rights. The question is decided by the ECHR, the lawyer said.
