The investigation does not respond to request of a lawyer Fuad Ahmadli
Investigative authority did not answer the request of the lawyer of the activist of the Popular Front Party of Azerbaijan (PFPA) Fuad Ahmadli. Lawyer Asabali Mustafayev is going to appeal the investigation inaction. On 14 December the lawyer submitted two petitions to the investigation in connection with the health of the defendant, asking for the medical examination and proving the impossibility of holding him in custody. Ahmadli suffers from pains, and it is impossible to conduct any survey in the prison conditions, the lawyer said. Another petition is related to the return of items seized during the search of Ahmadli’s house – his PC, his grandmother's pension card, and Fouad’s medical insurance documents. These documents do not have any relevance to the investigation. However, a lawyer Mustafayev told Turan, that the investigation over this period has not responded to the petition. The lawyer intends to take appropriate action and to appeal the inaction of the investigative body. The investigation into Ahmadli’s case is carried out by the Investigation Department for Serious Crimes of the General Prosecutor's Office. On December 31 Mustafayev visited Ahmadli in the Kurdakhani jail. Activist maintains good spirits. "Fuad Ahmadli has got health problems with the lungs and airways," told the lawyer. On December 8 Ahmadli’s grandmother died. However, the management of the Prison Service did not satisfy the lawyer's request to release the activists to the funeral. PFPA activist Fuad Ahmadli was arrested on 18 August this year. He is charged under articles 302 (violation of legislation on operative-search activity) and 308-1 (abuse of power). In a joint statement, Prosecutor General's Office and the State Security Service said Fouad Ahmadli, working as an operator in the Call Center of LLC Azerfon, gave away personal information of the customers, printouts of calls and other private information. Ahmadli also was allegedly related to the Fethullah Gulen network. It is alleged that leaflets related to Gulen were found in his apartment. However Ahmadli deies the accusation and says its fabricated and politically motivated. Human rights organizations have recognized him as a political prisoner. -05B06-
