At Nardaran Trial Defendants Not Allowed into Hall Again

The next hearing on the Nardaran case on December 21 in Baku Court of Grave Crimes passed again without the participation of the accused.

Their lawyers have petitioned about ensuring the participation of the defendants at the trial.

The lawyer Yalcin Imanov drew attention to the fact that the accused is brought from prison to court, but the whole day kept in the cold concrete basement, which is why four of the accused have already got seriously ill.

Another lawyer Javad Javadov described the content of the accused in the cold concrete basement as a violation of Article 3 - "prohibition of torture" of the European Convention on Human Rights.

The lawyer Zibeyda Sadigova drew the court's attention to the psychological state of the accused.

She noted that for two months the accused was contained in the General Directorate for Combating Organized Crime (GUBOP) Ministry of Interior and tortured. That is why they painfully and emotionally react to injustice in court and because of this they should not be punished by removal from the hall.

However, the presiding judge Alovsat Abbasov dismissed the petition.

Next, at the request put forward by Sadygova at an earlier meeting the officer of GUBOP Ibrahim Kazimov was invited to court again.

According to the case file, Kazimov during a special operation in Nardaran detained Sadygova’s defendant Rasim Jebrailov.

Kazimov in court argued that Jebrailov was arrested November 26, 2015 in the courtyard of the house in Nardaran, when shooting with a pistol. According to police, Jebrailov was detained after he ran out of ammunition.

Jebrailov said Kazimov did not say the truth. He was detained by people in masks in the kitchen of the house where the special operation was carried out against the believers. “So it turns out that I was shooting in the yard from 5-6 meters and missed Kazymov? In the courtyard a grenade exploded and still nothing happens with Kazymov. By God, that was all a lie. There was no grenade. On our side, no fire was opened,” said Jebrailov, which because of the cross-examination was led out of the basement.

He also spoke about the torture of detainees in the furniture truck.

"We were put in a furniture truck. On the way to the police we were subjected to terrible torture. They beat us over the head with submachine guns. They (police) walked upon us as if upon bags of potatoes, and kicked us and gave us slaps. In the police station they committed acts that did not befit a man,” said Jebrailov.

Kazimov refuted Jebrailov’s reports of torture.

The next meeting on the Nardaran case is scheduled for December 23.

Note that in protest against non-admission of the accused into the room their families refused to participate in the meeting.

According to the lawyers, the defendants continue the hunger strike started on December 19 to protest against the suspension from participation in the trial. -36C06-
