Lawyers Urged to Acquit Intigam Aliyev
On the trial of the human rights defender Intigam Aliyev today the counsel for the accused issued a final word.
Shahla Humbatova in her speech stated that all the items of the charges against Intigam Aliyev were false.
The basis of the charges is implementation of projects without registration of the grants at the Ministry of Justice, which is qualified as "illegal business".
However, Aliyev presented the grants to the Justice Ministry, which did not provide data on the registration.
The Ministry of Justice until 2013 exhibited the information on its website, but then removed it from the site, but the Cache option page with information about the registration of the grants was preserved by the Legal Education Society.
The accusation of "attribution" is also not consistent because it involves misappropriation or appropriation of "other people's property." In this case we are talking about grants - property of the donors. However, donors have reported the absence of claims and presented documents that they are satisfied with the implementation of projects.
The accusation of "attribution" is based on the allegations of the former accountant of the Legal Education Society Gulshan Orujova that on behalf of Aliyev she transferred money to the account of her sister and then transferred it to Aliyev. However, in the materials of the case there are clearly falsified signatures of Aliyev, but the court rejected the petition for their examination.
The lawyer Javad Javadov said that at the time of Aliyev’s arrest in August 2014 there was no evidence of his guilt, since the accusations of “assignment” and “tax evasion” were introduced only in November.
He reported the political motives of Aliyev’s persecution due to human rights activities.
The lawyer Elchin Sadigov pointed the illegality of the accusations about not paying taxes. So, at that time grants were not subject to VAT.
The lawyer Fakhraddin Mehdiyev called Aliyev an intellectual and a lawyer recognized in the international arena and described him as a model of "honesty and integrity".
All the lawyers urged the court to acquit Aliyev.
