On November 15th Plenum of the Supreme Court will hear the case of Ali Insanov
The Plenum of the Supreme Court, which will take place on November 15 at 15:00, will consider the decision of the ECHR in the case of the former Health Minister, Ali Insanov, according to the Secretariat of the Plenum of the Armed Forces. On 14 March 2013, the ECHR ruled against Ali Insanov, satisfying the claim of the ex- minister against the government of Azerbaijan due to violation of his rights to a fair trial, and the use of torture against him.
According to Insanov’s lawyer, Togrul Babayev, in connection with the decision of the ECHR, the Plenum of the Supreme Court should cancel the sentences the Azerbaijani courts, and release Insanov in the courtroom. Furthermore, according to the decision of the ECHR, the government of Azerbaijan must also pay Ali Insanov 10,000 euros compensation. The ECHR’s decision came into effect on June 14.
According to law of Azerbaijan, the ECHR's decision should be transferred by the Chief Justice to one of the judges of the Supreme Court and then be put to the Plenum not later than three months after its receiving by Azerbaijan.
Ali Insanov accused the president of the Supreme Court and Plenipotentiary of Azerbaijan to the ECHR of violation of the law and appealed to court against them. Insanov repeatedly complained to the CE’s Committee of Ministers.
Ali Insanov was arrested on the eve of the 2005 parliamentary elections. First, he was accused of an attempt of coup, then the charge was separated, and in April 2007 he was convicted of economic crimes, and sentenced to 11 years in prison—06D--
