The court heard testimonies of Tapdig Farhadoglu
On December 3 the Yasamal District Court chaired by Azer Tagiyev continued examination of the application of the correspondent of radio "Voice of America" Tapdig Farhadoglu against the Yasamal District Prosecutor's Office investigator Mubariz Asadov.
The complaint was filed in connection with the refusal to file a lawsuit due to the attack on the journalist while covering protests of students in Baku State University (BSU.)
On February 20 the head of the Security Service of BSU, Mahir Hojjatov repeatedly kicked with his hands on the back and the head of the journalist, who was filming the protest of students. At today's meeting the journalists were not allowed, although at the previous meeting the press was present. The registry is motivated by requirements of the legislation. According to Farhadoglu, the trial watched the videos.
The judge Azer Tagiyev said after watching that there were "has action and there are injuries" against the journalist. The judge added that after the investigation of evidence, the court will announce its decision on 8 December.
Farhadoglu also noted that investigator questioned as witnesses only guards of BSU.
The investigator Mubariz Asadov claimed that the incident does not qualify as preventing the activity of journalist, because "there was no live video."
However, Farhadoglu explained that under the law, the dissemination of information is not a video broadcast, it is data collection, production and dissemination of information. In addition, the journalist asked the court to establish whether Hojjatov is the head of the BSU guard, whether he has the authority to detain citizens and to use force, and if he exceeded his powers?
He also noted the need to investigate the cause of bodily injury and compensation for his treatment costs.
Farhadoglu said he hopes that the court's decision and re-investigation will be objective because of violence against journalists and preventing their lawful professional activities causes damage to the image of the country. -06В-
