The trial in the case of  "immoral  water pipeline" is  delayed

Today,  on February 22, was to be held a trial in connection  with  the refusal of Azersu OJSC to respond to a request for information agency Turan on July 27, 2016. However, the meeting did not take place for the reason that in a lawsuit the plaintiff was listed director of the agency Mehman Aliyev, as a physical person. He, in turn, refused to speak on behalf of the individual, stating that the request was on behalf of the agency. The judge offered to create a new lawsuit on behalf of the Agency,  and Aliyev agreed.

The  information request was sent in connection with the preparation of material for the construction of "immoral water pipeline"  by the Azersu state company for a couple of high-ranking officials of the president Aliyev’s administration in the settlement of Buzovna suffering from a shortage of water.

The Agency wrote  two articles  on the subject,  and obtained the suspension of construction. But later  at  night,  Azersu completed the  construction of the  unfinished part of the  water pipeline, and it was put into operation.

On October 11, 2016 the Agency appealed to the  Administrative Economic Court №1, to get an answer in the manner prescribed by law (Freedom of Information Act, about the fight against corruption, administrative offenses, the Administrative Procedure Code), but the letter was lost in court.

On December 5, 2016 the agency repeatedly appealed to the court. A judge Tahir Asadov on the same day, referring to the Code of Administrative Procedure, sent a letter to Azersu, calling on the company to submit to the court a response to the  information request  from Turan agency.

A month later, the  Director of the Turan Agency  Mehman Aliyev reminded the judge Asadova  about the absence of a response, and asked to appoint a judicial  trial.

On  January 9 Asadova again sent a letter asking for an answer, stating that   there was not answer for her request  sent on December 5. And again, at the  insistence of  Aliyev  on January 25 Asadova appointed a hearing on February 22.

It is noteworthy that the trial of another lawsuit of the Agency against Azersu in connection with water meters the  judge Sharafat Mammadova clarified whether Aliyev acted on its own behalf or  on  behalf of the  agency and does he see the  defendant  the head of Azersu or the company itself? After Aliyev said that  he presented the claim on behalf of the legal person against a legal entity, were demanded  the relevant documents  of the agency, and the  trial continued. A total of nine  hearings were held,  and they were partially successful. The Agency intends to obtain a complete response from Azersu through the Court of Appeal.-0-
