Dismissal of a man who distributes the video of the accident in the "Athletes Village" is unjustified,- lawyer
The dismissal of a police officer, who placed on the Internet a video of accidents involving Austrian athletes is unfounded, said an expert in media law, Alasgar Mammadli. On his Facebook page, he wrote that in this case the talk is about the dissemination of information about the offense of public importance.
According to Mammadli, the practice of democratic states has a concept - "the protection of whistleblowers." According to this principle, the prosecution of informants is unacceptable.
In 2005, Azerbaijan passed a law on obtaining information, which implies the protection of whistleblowers, said the expert.
Therefore, by firinmg an employee, the Interior Ministry violated Article 6.1.11 of this law. It reads that officials disclosing information about violations of public importance should not be prosecuted.
The control over the execution of the law is assigned to the Ombudsman. Therefore, the Ombudsman should provide his returnm to his job, Mammadli said.
In addition, the Code of Administrative Offences contains an Article 181-3.5, responsible for providing prosecution official to disclose information of public interest.
For the dismissal of the police said an individual relies a fine ranging from 80 to 90 manat, and a legal person - 250-300 manat.
Mammadov does not agree with those who justify the dismissal of a police officer for violating duty. Firstly, the video of the accident does not represent an official secret.
According to Article 34.2 of the law on obtaining information, this information is considered public information.
Article 7 of the law on state secrets reads that information on emergencies and accidents that threaten the lives and health of people, natural disasters do not belong to state secret and are not made secret.
Hitting three people causing them bodily harm is an accident, which is a threat to life and health of people. Therefore, the frames of an accident, regardless of source, are considered public information and government agencies were to disseminate this information immediately , he said.
