Ministry of Emergency Situations is not going to indemnify victims of flooding
Ministry of Emergency Situations (MES) has introduced an "innovation" in the process of eliminating the flood of 2010. On Thursday at the trial in the Court of Appeal of Shirvan region, on the claims of 16 residents of Imishli region, the representative of the MES, Vugar Hajiyev, tried to explain to the court that the flood victims themselves must rehabilitate restore housing, at their own expenses. Hajiyev who spoke on behalf of the Ministry of Emergency Situations, tried to justify the refusal to build or renovate housing, referring to the Housing Code.
The Article 21 obliges the landlord to restore independently its operation even in the event of a disaster, and the Article 28.5 only allows the participation of the executive power in the reconstruction.
In protest, submitted to the court, Hajiyev stated on behalf of the Ministry of Emergency Situations that neither the state nor the state agencies must reimburse the full damage. Hajiyev said that the allocation and issue of compensation have been clearly noted in the resolution of the Cabinet of Ministers N.197.
Representative of the MES said that some of the complainants have been paid partial damage.
It was the first participation of a MES representative in nine trials that took place in the Court of Appeal since September 3. Against MES 132 suits have been filed.
The protest of MES means that the state fails to meet its obligations to the victims, despite the fact that 0.5 billion manta have been allocated for the flood relief; only 3.500 houses have been built, cash compensation amounting few million have been issued, and some works have been conducted in the disaster area, which swept through eight regions.
Headquarters of the civil society "Kura" recorded numerous cases of corruption and embezzlement of public funds, most of which has been misappropriated. The MES is responsible for flood relief, which refuses to report on grant of cash compensation, the constructed houses and estimation of works.—0—
