Prosecutor asked to convict murderer of LGBT activist to 10.5 years
Baku/29.07.22/Turan: At the Baku Serious Crimes Court on July 25 at the trial of the murder of reporter and LGBT activist Avaz Shikhmamedov (Hafizli) the prosecutor made a closing speech.
He asked to convict the accused Amrulla Gulaliyev to 10.5 years of imprisonment finding him guilty under Article 120.1 (premeditated murder).
The prosecutor noted that there are "mitigating circumstances" in the case - the defendant's admission of guilt, confession, as well as the commission of the crime for the first time. At the same time, the brother of the deceased, Tabriz Shikhmamedov stated that the injured party "forgives" Gulaliyev.
"Amrulla Gulaliyev is like a member of our family (cousin). Therefore, we forgive him. Therefore 10.5 years of imprisonment is a very heavy punishment. Prosecutor could have asked for a more lenient punishment," the Azerbaijani service of Radio Liberty quotes the brother of the deceased.
He also submitted to the court a notarized statement by the mother of the murdered man that she had no complaints to the accused.
However, LGBT+ activist Aziz Melikov considers the punishment proposed by the state prosecutor "very small". According to him, there are signs of murder with special cruelty in the case, since Hafizli was stabbed 7 times. An aggravating circumstance is the commission of a hate crime.
* *Avaz Shikhmamedov (Hafizli) was killed on February 22 this year by his cousin Amrulla Gulaliyev. The latter stated that Avaz "disgraced the family", that he repeatedly demanded from him "to give up" his non-traditional sexual orientation, but in vain.
Hafizli was a reporter and covered protest actions, including against harassment of representatives of the LGBTI+ community. He was subjected to open threats and carried out single actions demanding to punish those responsible for harassment.-06B-
