The Supreme Court upheld the verdict of the convicted in the case of an attack on a journalist
Baku/03.04.19/Turan: The Supreme Court of Azerbaijan today, under the chairmanship of Khafiz Nasibov, considered the cassation appeal of Kanan Madatov and Arif Aliyev, convicted in the case of beating journalist Rasim Aliyev, who died later in hospital.
At the beginning of the meeting, the petition of another convicted person in the case, Jamal Mammadov, was considered, who asked to consider the passage of the cassation deadline as valid. However, the court dismissed the petition, because the defense did not substantiate the reason for missing the appeal period.
Madatov"s lawyer has declared his client"s innocence. According to the defense, Madatov did not beat the journalist, but on the contrary, he wanted to help him, and this was captured on video surveillance cameras.
The lawyer pointed to the coincidence of the positions of the defense and the injured party that doctors are to blame for the death of the journalist.
The lawyer, Arif Aliyev, said that the investigation qualified the actions of his client as "grave", which is not adequate to his act. He asked the court to dismiss the charges under Article 126 (deliberate infliction of severe damage to health), to a less serious article and mitigate punishment.
The mother of the murdered journalist Teyfur Aliyev said that all those involved in the case were guilty of the death of her son. She pointed out that it was Kanan Madatov who brought all the others to the crime scene, and knew what purpose they were going there. He then took them all back and did not help the journalist.
The prosecutor asked to uphold the decision of the appellate court. As a result, the Supreme Court upheld the decisions of the lower instances unchanged.
* Journalist Rasim Aliyev was beaten on August 8, 2015 by the relatives of football player Javid Huseynov because of the criticism of the latter on Facebook. With severe injuries, the journalist was taken to the city clinical center N1, where he died a day later.
Note that in the case of the death of Aliyev 6 people were arrested. The case against Huseynov at the end of the investigation was allocated in a separate proceeding. He is charged under articles 307.1 (not reporting on a crime in preparation) and 307.2 (concealment of a crime) of the Criminal Code.
On 3 May 2016, the Baku Serious Crimes Court sentenced five accused: Elshan Ismailov sentenced to 13 years in prison, Arif Aliyev to 12 years and six months, Jamal Mammadov to 11 years, Kanan Madatov and Samir Mustafayev to 9 years in prison.
On May 31, 2016, the Sabail Court sentenced football player, captain of the Gabala club Javid Huseynov to 4 years in prison, found him guilty under articles 307.1. (failure to report on preparing serious crimes) and 307.2. (harboring a serious crime). He was released early on December 12, 2016. -21C-
