State Property Committee Threatens to Demolish Greenhouse, Which Received Permission from Baku Executive Power
Baku / 29.07.17 / Turan: "Yesterday, employees of the State Committee for Property Affairs (SCPA), threatening to destroy property, tried to stop the construction of a greenhouse complex in the Mashtaga settlement of the Sabunchu district of Baku," the owner of the greenhouse Iskender Gurbanov told Turan IA.
According to him, the hothouse plant is being built on a plot of 28 hectares allocated for this purpose by the order of the head of the Baku City Executive Power No. 420 dated November 4, 2016 with the participation of the French company Richel. The project is included in the program of investment promotion of the Ministry of Economy of Azerbaijan. For its implementation a loan has been allocated through the National Entrepreneurship Support Fund (NFES). The project was originally designed for 250 new jobs and annual production of vegetables worth $ 10 million.
Answering the editorial office's request, the lawyer Eldar Huseynov, representing I. Gurbanov, said SCPA motivated his actions by the lack of a cadastral statement at the entrepreneur. An appeal was sent to this agency in March of this year, but so far the response has not been received. "There was another argument. It turns out that the head of the executive power did not coordinate his order with SCPA, but this is an interdepartmental problem that must be solved between the executive power of Baku and SCPA," Huseynov said.
He said I. Gurbanov turned to the issue of obtaining a cadastral statement back in March. "According to the law, the extract from the cadastre of SCPA was supposed to be provided in a month, but they did not do it, and the day before the employees of the Cadastre Service and the address register of real estate under SCPA came to the facility with threats to destroy the almost built-up hothouse plant. According to the law, such actions are not included in the powers of this structure, as this can be done by the Ministry of Emergency Situations after a relevant court decision," the lawyer commented, noting that the SCPA employees intentionally delay the issuance of an extract from the cadastre, creating such a situation.
In the light of what is happening, noteworthy is the SCPA statement made in March this year, where it is reported that the employees of SCPA have monitored the targeted use of agricultural land in the Ramana and Mashtaga settlements in the Sabunchu district of Baku. During the monitoring, it was revealed that the unauthorized construction on 25 hectares of agricultural land was initiated and measures were taken to prevent it.
SCPA was established on May 19, 2009 by the relevant decree of the President of Azerbaijan. The main activities of the State Committee are management of state property, attraction of investments, maintenance of a single cadastre of real estate and land, organization of the land market, protection and improvement of land quality. The Cadastre Service and the Real Estate Register are functioning under it. It is an executive authority ensuring the implementation of a single state cadastre in Azerbaijan, an address register of real estate, a state land cadastre, works on land management and geodetic works of special purpose. Supervision over construction and demolition of facilities is not included in the authority of the department. -0-
