Complaints against elections are formal - the results of monitoring
Complaints about violations during the election campaign in the courts of Azerbaijan was formal, and except for one case were rejected, stated in the report of the Institute of Democratic Initiative (IDI) on the monitoring of complaints.
The report reflects the period from 1 September to 27 October, when the tracked session of the CEC and the courts were studied opinion plaintiffs and defendants.
To address controversial issues have been established in the CEC expert group with the participation of 9 people, and district electoral commissions - 3 people.
According to the CEC, this structure accepted 97 decisions on complaints. Of these, 20 were granted, including 18 on the refusal of registration of candidates, 1 - a violation of the administrative body, 1 - on illegal campaigning.
62 complaints were dismissed, including 60 in connection with the refusal to register.
The appellate courts received 33 complaints, including 31 on the denial of registration, 1 - violation of voting rights 1 - to eliminate the registration of another candidate.
Of these, only one complaint was partially satisfied, and the case was returned to the CEC. All the rest were dismissed.
The Supreme Court examined 30 complaints and no one is satisfied. The report of the IDI noted that the grievance was formal and lasted 10-15 minutes.
The judges did not ask additional questions, not the evidence, interrupted stakeholders. Meeting decides to continue for 1 minute at times.
The district election commissions themselves complaints and formal decisions were based on subjective judgments.
The courts are not guided by the precedent decisions of the European Court of Human Rights and the recommendations of the Committee of Ministers of the Council of Europe on the implementation of decisions of the Strasbourg Court on electoral affairs of Azerbaijan.
