Council of Europe�s Committee of Ministers launches infringement proceedings against Azerbaijan
The Committee of Ministers of the 47-nation Council of Europe has launched infringement proceedings against Azerbaijan due to the authorities" continuing refusal to ensure the unconditional release of opposition politician Ilgar Mammadov following a judgment from the European Court of Human Rights in 2014.
In the first use of a procedure introduced in 2010, the committee has formally asked the court to decide whether Azerbaijan has failed to fulfil its obligation to abide by the court"s judgment in this case.
In May 2014, the court concluded that no facts or information had been produced in the domestic criminal proceedings giving rise to a suspicion justifying the bringing of charges against Mr Mammadov, or his arrest and pre-trial detention. The court found that the actual purpose of these measures was to silence or punish him for criticising the government.
In the judgment, the court found violations of Articles 5, 6 and 18 of the European Convention on Human Rights. Until November 2017, the court found a violation of Article 18 of the convention in only five judgments and in all of those cases, except Ilgar Mammadov v. Azerbaijan, the applicants were released.
Since December 2014, the Committee of Ministers has adopted numerous decisions and interim resolutions stressing the fundamental flaws in the criminal proceedings revealed by the European court"s May 2014 judgment and calling for Mr Mammadov"s immediate and unconditional release.
However, over three years since the court"s judgment became final, the applicant remains in detention on the basis of the flawed criminal proceedings.

Council of Europe member states are obliged to implement judgments from the European Court of Human Rights under Article 46 § 1 of the human rights convention; the Committee of Ministers is responsible for overseeing the implementation of judgments from the court
In 2010, a new procedure was introduced according to which the Committee of Ministers can ask the court, under Article 46 § 4 of the convention, to decide whether a member state"s failure to implement a judgment represents a further violation of the convention
On 25 October 2017, the Committee of Ministers adopted an interim resolution giving notice of its intention to refer Azerbaijan"s compliance with the Ilgar Mammadov judgment to the court and asking Azerbaijan to submit its views; these views were appended to the interim resolution adopted by the Committee of Ministers today.

Representatives of over 50 international organizations and leading universities in the UK and the world have appealed to the head of the Foreign Policy Department of the United Kingdom, David Cameron, on the case of Azerbaijani economist Gubad Ibadoglu. The message notes that Ibadoglu, who was released under house arrest during his detention, seriously undermined his health and now apparently needs a complex surgical operation, but he is still banned from leaving the country.

The National Council of Democratic Forces (NCDF) has scheduled a protest rally in Baku for May 19 demanding the release of political prisoners, electoral reform, improvement of the social situation of the population, and the opening of land borders. Earlier, the opposition had already scheduled rallies with these demands for April 21 and May 5. However, the Baku Executive refused to authorize opposition demonstrations.
