European Court Granted Complaint about Non-investigation of Soldier�s Death
Baku / 02.06.17 / Turan: On June 1, the European Court of Human Rights ruled against the Azerbaijani government on the complaint of the citizen Malik Babayev.
As the lawyer Fariz Namazli wrote on his Facebook page, the son of the plaintiff, Zakir Babayev, died on November 14, 2009 while in the fighting post. On the fact, the Military Prosecutor's Office opened a criminal case under Article 125 of the Criminal Code (bringing to suicide). Subsequently, the case was terminated due to the absence of a crime. Local courts upheld this decision.
However, the European Court considered that this case was not effectively examined and there is a violation of Article 2 of the European Convention on Human Rights. On this basis, the European Court decided to pay the plaintiff 150,000 Euros in compensation for moral damage. -03D-
