Second complain in the case R.Mirkadyrov sent to the European Court

 Due to keeping a journalist Rauf Mirkadyrov in  custody for two days without a court order, the defense filed a complaint with the European Court of Human Rights, according to  the lawyer Elmar Suleymanov.

Mirkadyrov was arrested on April 19, 2014 immediately after the deportation from Turkey. He was charged of high treason, and on 21 April, he was arrested for three months. Mirkadyrov is charged with espionage in favor of Armenia. Journalist denies the accusation, saying it is absurd and politically motivated.  On July 15 the arrest term was extended for another four months, which expired on November 19. However, the court only on November 20 extended the detention period for another five  months.

Thus, a journalist is illegally detained for almost two days.

The complaint to the ECHR raises the question on the violation of Mirkadyrov’s right for freedom and security of person, fair trial, guaranteed by the European Convention on Human Rights.

This is the second application of Mirkadyrov to the  ECHR. The first includes question of depriving it of access to a lawyer during detention in Turkey, the ban on meeting with relatives in jail without access to his notary, and others. On February 2, another lawyer  of the journalist, Fuad Agayev, met with Mirkadyrov in jail of the  MNS.

According to the lawyer,  Mirkadyrov’s health is satisfactory, but investigations against him  is not held.

Mirkadyrov complains that he  is not  provided with the newspapers "Azadlig" and "Yeni Musavat",  but  the state newspapers - "Azerbaijan", "Khalq", "Republic", and the pro-government newspaper "Yeni Azerbaijan", "Ses", "Iki Sahil". -03B06-
