Complain of OPON members will be considered in November
Today Baku Appeal Court held a preliminary hearing in the case of three OPON members. According to the lawyer Elchin Sadigov, the convicted in the case of the rebellion in 1995, Elchin Amiraslanov, Safa Poladov and Arif Kazimov appealed to the court with request to replace the life sentence of imprisonment for 15-20 years. Earlier Garadag court did not appeal to the production and the plaintiffs appealed.
The three convicts were arrested and sentenced to death. In connection with the abolition of executions in 1998, they were automatically assigned a life sentence. The Lawyer Elchin Sadigov told about the invalidity of the decision of Garadagh District Court. According to him, the Criminal Code which was in effect until 2000, provided for the replacement of a life sentence for 20-year sentence.
The lawyer asked to send a request to the Constitutional Court to testify interpretation of Article 23 of the Criminal Code in force until 2000. The Court of Appeal scheduled a hearing on the merits for 4 November.
