Headmaster Does Not Plead Guilty of Elina Hajiyeva's Death

Baku / 02.10.19 / Turan: On Wednesday, October 2, at the trial of the death of a student of Baku school number 162 Elina Hajiyeva, the accused, the former director of this institution, Sevinj Abbasova, was heard.

On April 4, 2019, a school student Elina Hajiyeva jumped from the third floor of the school. A criminal case was filed under Art. 125 (suicide) of the Criminal Code.

Subsequently, the director of the school, Sevinj Abbasova, was brought to justice. She was charged under articles 143 (leaving in danger) and 314.2 (negligence resulting in the death of the victim) of the Criminal Code. However, under article 125 (suicide), no one was held accountable.

Abbasova in her testimony noted that on the day of the incident she saw two schoolchildren carrying Elina who had fallen from the window in her arms.

"I asked Elina who pushed her, and she answered, "No one pushed me, I fell," said Abbasova. According to her, the girl was put to bed in her office, as the first-aid post was closed. "Elina said she had been taking tramadol for three months. However, the last three days due to the fact that she could not get tramadol, she took 1 pack of ketatiphene. Her bag had 1 box of ketatifen. Then a nurse came and said there were no visible injuries and no fractures.

I did not know who was the first to call the doctors. But the investigation found that I was the first to call the doctors. Then we informed the parents ... About 10 police officers took evidence from me. They asked about the pills. Elina answered most of the questions.

Then came Khalida Bayramova (deputy head of the Sabail executive authority, at that time the head of the district commission for guardianship and trusteeship). The police pulled a sheet from Elina"s bag containing the names of 20 psychotropic drugs. There was also a diary of Elina, in which it was written: "52 days are left until my death, my life is like garbage." Khalida Bayramova went to the ambulance with Elina," said the former principal of the school.

Abbasova herself also later went to the hospital and saw Elina when she was taken to an ultrasonic examination.

"Elina said, 'Let someone of the guys come to me' and said hello to them. After the ultrasonic examination we were told that everything was in order, only there was a spot on the bladder. Doctors said that if it was blood, then it would be necessary to do an operation. Elina heard about this, but was not much scared. On April 6, when I testified at the prosecutor"s office, I learned that she had died," continued Abbasova.

When asked by the prosecutor whether Abbasova pleaded guilty, she answered like this: "Prior to reading the case materials, I partially pleaded guilty because I did not know that Elina was tortured at school. Now, I plead not guilty. I called the doctors late because I was in a state of affect. I don"t remember who I called. Elina discussed with the psychologist only the issue of hair coloring. There were no notes on the desire to commit suicide. When Elina cut her throat for the first time, I asked for the reasons, and she didn"t answer - she said 'to look 'cool.' She even posted her photos in that state on İnstagram. I am comforted that Elina did not die at school, but two days later in the hospital ... I do not remember that Khalida Bayramova gave me instructions to wait for her. As regards my failure to call (meaning late call) the doctors, no one gave me any instructions," said Abbasova.

During the meeting, a civil lawsuit filed by the injured party was also discussed. The lawyer of the injured party presented a document on the dismissal of the school principal by the Ministry of Education under Art. 70 of the Labor Code.

"According to the law, the employer is responsible for his employee. We ask for payment of AZN 8,500 for funeral and commemoration expenses and AZN 100 thousand for moral damage," the lawyer said, indicating that both the former school principal and the Ministry of Education were defendants in the case.
