Lawyer Bagirov: Sadigov Trial Conducted with Gross Violations of Law
The trial of the advisor to the head of the party Musavat Yadigar Sadigov charged with disorderly conduct is carried out with gross violations of the law. Such an opinion in an interview with Turan was expressed by the lawyer Khalid Bagirov, commenting on the cognizance of the Musavat activist that started on Nov. 12.
Recall that Sadigov was arrested on June 27 as a suspect on the basis of the complaint a resident of Lankaran , a veteran of the Karabakh war Rashid Karimov . The latter claims that Sadigov for no reason insulted and then beat him in a teahouse. In Lankaran district police prosecuted Sadigov under Art. 221.3 (hooliganism committed with weapons or objects used as weapons) of the Criminal Code. November 5th they held a preliminary hearing on the case.
November 12 the lawyer was not allowed to his client in prison of Lankaran police. Moreover, the lawyer saw before the trial that the investigator instructed the witnesses for the prosecution.
In the course of trial at Lankaran district court the chairman of the court Elchin Kazimov ignored an elementary petition to allow the accused to sit down with his lawyer, Bagirov said. In this case, the lawyer showed photos of the Norwegian shooter Breivik, who, despite the killing of 80 people at a trial was sitting next to his lawyer. However, it had no impact on the judge.
Bagirov said that both at the preparatory meeting and at the hearing on the merits the defense declined Kazimov as the judge.
"This judge has no right to lead the trial. He once sanctioned the arrest of Sadigov and is therefore a biased person in the case. At the same time he was involved in the decision to arrest Sadigov presented as a person who had committed a crime, violating the presumption of innocence of my client," continued the lawyer.
But the violations by the judge do not end there, he added. When he received the criminal case, he voluntarily without meeting extended the arrest of Sadigov, although at the preparatory session of the court the trial judge is not entitled to extend the term of arrest.
The judge himself considered and rejected the objections against his work. Bagirov also said the judge rejected the request for photo and video.
Regarding the charges, Bagirov claimed fraud the criminal case.
According to the lawyer, the defense has evidence that the complainant Karimov is a drug addict and has a prior conviction under this article.
In addition, Karimov said that dizziness and insomnia had arisen at him as a result of a contusion on the Karabakh front in 1992, while the investigation claims that it is "a result of beatings by Yadigar Sadigov."
Witnesses for the prosecution are not residents of the Lankaran city, but are from villages of the area. "These people are not even able to describe the teahouse, which indicates the effect. They are employees of rural administrations or municipalities, or are people close to the local police authorities," said the lawyer.
The next hearing is scheduled for 14.30 on November 22.
Sadigov rejects the charge and says it is politically motivated.
