Afghan Mukhtarly: Questions of European Court to Governments of Georgia and Azerbaijan
Baku / 06/19/18 / Turan: The European Court has started investigating the complaint of the convicted journalist Afgan Mukhtarly for several episodes, the ECHR website states.
Mukhtarly's complaints are directed against two states - Azerbaijan and Georgia. In court, he is represented by both Azerbaijani and Georgian lawyers.
In the ECHR information there is a reminder of the repeated detention of Mukhtarly for his participation in actions in Baku, his abduction in Tbilisi on May 29, 2017 with the subsequent transfer from Georgia to Azerbaijan and the arrest in Azerbaijan.
The European Court will consider several episodes on the arrest of Mukhtarly. It's about his pre-trial arrest and personal search, illegal interference in his mobile phone data, his abduction in Georgia, and also the inhuman treatment with him.
The Georgian lawyers of Mukhtarly in a complaint to the European Court noted violations of Article 1 (obligations on respect for human rights), Article 3 (prohibition of torture), Article 5 (right to freedom and inviolability), Article 6 (right to a fair trial), Article 8 (right to respect for private life), Article 10 (freedom of expression), Article 13 (right to effective remedies), and Article 18 (restrictions on restrictions on rights).
The Georgian lawyers also claim violation of Part 2 (freedom of movement) of Protocol No. 4 of the Convention, Article 1 (guarantees of expulsion of aliens) of Protocol No. 7, and Article 1 (prohibition of discrimination) of Protocol No. 12.
The Azerbaijani lawyers of Mukhtarly claim violation of Articles 1, 5, 6, 10, and 18 of the Convention. The European Court sent 12 questions to the governments of Azerbaijan and Georgia, as well as lawyers, to consider the articles reflected in the complaint.
Of these issues, 6 are addressed to the government of Georgia and the lawyers, and 4 issues - to the government of Azerbaijan and the lawyers. The European Court also sent two questions to the governments of Azerbaijan and Georgia. On the questions sent on May 30, answers shall be given within three months. -0-
