Another demolition in Bail settlement

In the settlement of Bail in Baku began the demolition of private houses around the Palace of Water Sports being built. This angered the local residents, who do not agree with the proposed compensation of 700-800 manats per 1 square m.

As the head of a department of the Sabail District Executive Power Israfil Kerimov told Turan, the demolition will regard the housing at the intersection of Ahad Yagubov Street and Bibi-Heybat Highway.

About 130 IDP families living in the Vocational School dorm have already moved. Their relocation was arranged by the State Committee for IDP and Refugees and the people were housed in the new settlements for refugees.

Other residents receive cash compensation: those having legal documents on the real estate are paid AZN 1,500 per sq. m.

For those who have no documents at all, the compensation is paid on the basis of their construction costs at the market prices of the building materials used. The amount of the compensation is established by the State Property Committee's commission.

As noted by Kerimov, this area is on the balance of SOCAR.

In turn, the head of the department on work with territorial authorities of the administration of the Sabail district, Gurban Ismailov said that the demolition will regard 13 one-story houses . According to him, legitimate rights of the property regards only one of the houses. Nevertheless , the state has decided to satisfy the people and pay the compensation on the basis of their costs of building materials in the construction of the houses.

According to him, "many residents have already moved out, receiving the compensation."

"Only 2-3 families remain, and negotiations are held with them, and we hope that they will also move out," said Ismailov .

An expert in the field of property , head of the NGO Promoting Economy Zohrab Ismail, commenting the situation, said that these homes should not be considered illegal.

"The people had some construction permits - from municipalities or local authorities. In addition, the state supplied them the due communications - gas, water and power lines. The state actually recognized their right to live there and the people actually acquired the ownership," said Ismail .

Also, there are precedent decisions of the European Court of Human Rights, according to which the state is obliged to pay the residents "adequate compensation" in such cases.  -06c -
