Supply of Utilities to Houses without Documents Complicated

Baku / 08.02.18 / Turan: The transfer of utility services to the ASAN Utilities centers from the year before last has complicated the supply of water, gas and electricity to houses without documents. Recently, the issue of installing electric meters to such subscribers was discussed between Azerishig OJSC and the State Property Committee of the Republic of Azerbaijan. This circumstance was pointed out by the representative of Azerishig Elsevar Rustamov.

Turan's interlocutors stressed the urgency of the problem, taking into account the scale of illegal construction that unfolded in Baku and on the periphery of the capital. The number of unregistered owners of residential real estate is unknown, and therefore, it is difficult to outline the extent of the problem. "In addition, utilities are not limited to electric meters, and illegal houses are deprived of the opportunity to connect to gas, water and sewage," said Rasul Suleymanov, director of the Association of Energy Specialists of Azerbaijan. "This issue requires a decision at the state level."

The fact is that when building a house with the subsequent registration of a deed, as we usually do, individual builders violate the law, since before constructing a house, it is necessary to produce the relevant documentation, obtain permission from local executive authorities to divert the land, and connect to the services of water and sewage, gas and energy. But such issues in Azerbaijan are beginning to be solved after construction, when people already live in the house, the interlocutor explained.

However, the process of such construction is not uncontrolled, as it is monitored by the local executive authorities and law enforcement agencies, and if allowed to build a house, it is logical to allow its residents to connect to public services. "If you are consistent, the house either needs or be demolished by a court decision, or its owners should be allowed to connect to communications. Meanwhile, according to Suleymanov, there is one more point related to refugees and IDPs, as their housing remains untouched until the resolution of the Karabakh conflict with the subsequent return of citizens to their homes. Taking into account this and other circumstances, the government faces a difficult task ".

Meanwhile, before the transfer of services related to Azerishig, Azersu and Azerigaz to the centers of ASAN Utilities of the State Agency for Services to Citizens and Social Innovations, the issue of connecting to communications and installing meters was solved simply - on the basis of the application. The utility provider installed the meter even to persons not registered at the place of residence who did not have a residence permit. "The citizen was only required to pay for services, as otherwise they would block light, gas and water. Now this is done through the centers of ASAN, which cannot register an illegal construction, since they do not and cannot have such powers. Accordingly, a house that does not have a registration cannot be connected to communications, otherwise the owner will have rights that he can prove in court, demand a purchase, etc." explained Suleymanov, noting that the installation of two or more meters in one house is allowed, but this will require a rationale: "The applicant must answer the question why he needs a second counter.

With the transition to a differentiated tariff system, entrepreneurs do not have benefits intended for users of the "population" group. For example, if the meter takes into account the energy consumption associated with production activity, there is no preferential limit in this case, the subscriber is provided with a device of the required capacity. If it is a question of the division of the family, a court decision is required for divorce, etc. As for the ASAN centers, citizens' applications are accepted here and sent to the appropriate authorities, since the services in ASAN Utilities are organized jointly with Azerishig, Azersu and Azerigaz. "

Meanwhile, according to the information provided by the director of the Association of Realtors of Azerbaijan (ARA), Elnur Azadov, there is a law in the legislation when utility bills for meter installation costs fall on the tenants themselves. It is widely known that in the newly populated areas, mostly private houses, the state installs only the lines, and the costs of building communications directly into the houses are borne by the owners themselves. According to the expert, it is required to speed up the process of registering housing under the appropriate list of documents for real estate acquired before the entry into force of the law "On the state real estate register" for ​​eliminating bureaucratic obstacles and facilitating related procedures. Meanwhile, on the periphery of the capital, construction of housing continues, which does not even have basic permits.--0--
