Leyla Yunus calls to bring Abutalibov to justice
The Institute for Peace and Democracy (IPD), called to bring Baku mayor Hajibala Abutalibova to justice for violation of the laws and the rights of citizens. The reason for this action is the arrest, for 10 days, of PFPA youth activist, Tofig Dadashov, who called for the resignation of Abutalibov. The IPD believes that we must formally apply to law enforcement agencies demanding Abutalibov be brought to justice. The statement noted that since 2011, the IPD has called on the law enforcement agencies of Azerbaijan to bring Abutalybov to justice.
From February 2010 to June 2011 the IPD, in response to the call of President Ilham Aliyev to the citizens to fight corruption and to inform about known corruption, sent eight letters to the head of state, the Chairman of the State Commission Against Corruption, the heads of the Interior Ministry, the Prosecutor General, and the Supreme Court.
Abutalibov and his subordinates, according to the director of the IPD, Leyla Yunus, committed crimes under the following articles of the Criminal Code: Articles 107 "Deportation or forcible deportation of population," Article 157.3 "Violation of housing inviolability", Article 178.3 "Fraud committed by an organized group of people and causing large scale damage," Article 179.3 "Theft and squandering of public funds in the large-scale and organized group of individuals," Article 186.2 "Deliberate destruction or damage to property that caused grave consequences," Article 308.2 "Abuse of power that led to grave consequences," Article 309.2 "Abuse of power resulted in grave consequences," and Article 322.2 "Arbitrariness."
In 2013, the IPD won a series of lawsuits against the executive power of Baku, and in the courts of all levels up to the Supreme Court of Azerbaijan Republic. In the period from October 2013 to February 2014, ten letters on the need of judgments were sent to H.Abutalybov, including a letter signed by Araz Huseynov , the Head of Department for enforcement of judgments of Sabail District, and a letter from the Judicial-Legal Council signed by Senior adviser, Zahid Mammadov, etc. However, all these letters were ignored.
"Under current law, based on the submissions of bailiffs, the Investigation Department of the Ministry of Justice should institute a lawsuit against H.Abutalybov for willful failure to judicial decisions, says the IPD, and actively encourages citizens to demand the law enforcement agencies to file a lawsuit against officials who commit crimes. -06D-
