Court refused to ban journalist from leaving the country
Baku/15.02.22/Turan: Binagadi district court judge Saadat Salimova refused to satisfy the request of bailiffs to ban Meydan.Tv reporter Sevinj Vagifgyzy from leaving the country.
The submission to the court was made by the execution department of the Binagadi district following the claim of the deputy director of school № 251 Elmira Alandarova. She filed a lawsuit back in 2019, demanding an apology, monetary compensation of 2,500 manatы, and removal of the April 11, 2018 Presidential Election report from the network.
The reportage titled: "ELECTION 2018: 'Vice Principal Controlling 'Carousel' in Elections." showed voting at three polling stations at school No. 251.
The story showed Alandarova directing groups of female teachers around the school on the election day.
The court of the first instance took no sanctions against the journalist; however, it decided only to change the title of the report. However, the Baku Court of Appeal ordered the journalist to pay a fine of 1,000 manats, remove the video, provide a retraction and "apologize." The Supreme Court upheld the verdict.
On January 14, Vagifgyzy was informed that the court enforcement authority applied to the Binagadi district court demanding a ban on her departure from the country. The bailiffs accused her of "failure to execute the court decision", and in particular, of not removing the video.
Vagifgyzy considered this requirement against her as unfounded, as she had paid the court-ordered compensation. As for other claims, she had previously submitted to the execution department of Binagadi district a certificate from Meydan TV that the video belongs to this edition and only the editorial board can make decisions on it.
"Meydan TV and the newspaper Azadlyq which published the video, sent official letters to the court stating that they do not intend to remove the video.
With this in mind, the judge of the Binagadi court on February 14 did not satisfy the requirement to impose a ban on my departure from the country, "- said Vagifgyzy to the agency Turan.
However, she considers the lawsuit against her as unfounded and intends to seek the ECHR recognition of her punishment as unlawful.
Vagifgyzy has already been banned from leaving the country in 2015-2019 in the criminal case against Meydan TV. The ECHR subsequently found this ban unlawful.-06B-
