Accelerated registration of houses may last for a year
Baku / 21.02.19 / Turan: A presidential decree of February 19, 2019 "On simplifying the issuance of permits for the operation of certain multi-storey buildings" caused a revival among residents of houses that do not have state registration. The lack of state registration deprives people of obtaining a certificate of ownership of an apartment, sell or donate it. The decree covers about 10 thousand people living in almost 400 multi-storey buildings, not taken into operation. The chairman of the State Committee for Urban Planning and Architecture Samir Nuriyev told reporters, the main reason for not accepting buildings is the incompleteness of paperwork due to the irresponsibility of housing cooperatives.
The second reason is the deviation from the approved project during construction. In addition, there are housing cooperatives that have completed construction and the building is ready for state acceptance, but the housing cooperative does not hand over the building of the state commission, because after that the housing cooperative is obliged to transfer the management of the building to its residents.
Rafig Jalilov, deputy chairman of the State Property Committee, believes that some construction companies are not interested in accepting their buildings for operation, since after that the company loses the opportunity to earn money by selling apartments. There are cases of refusal of state registration due to the refusal of land owners to transfer ownership of a construction company, the former chairman of the Yasamal-2 housing cooperative K.Ali told Turan. "Having transferred the constructed building to its inhabitants, the housing cooperative will lose monthly profits from managing the house paid by the residents," he added.
Publications appeared on the forthcoming substantial acceleration of the state acceptance of buildings, but Elkhan Asadov, deputy chairman of the State Agency for Construction Control at the Emergency Situations Ministry, explained that the accelerated state acceptance process could drag on for a year, after which the building might not be registered.
According to the presidential decree, from January 1, 2019, all such buildings will be inspected within 2 months, after which, based on the opinion, the Emergencies Ministry is obliged to eliminate the deficiencies in five months. If the deficiencies are not eliminated, the housing cooperative will allow the building to be used for another five months to correct the inconsistencies with the project. If this does not happen again, the building will not be subject to the decree," said Asadov.
The decree obliged the utilities to ensure gas, water and electricity accepted for building operation within a month after state acceptance. The decree also obliges the State Committee for Urban Planning and Architecture to place on its website a list of residential buildings adopted by the state commission. The State Committee for Property Affairs is obliged to change the status of the land plot on which it is built within 10 days after the state acceptance of a residential house, if it was not allocated for the construction of this object. The State Committee is obliged to issue a certificate of state registration within 7 days after completion of the inspection. -0-
