Prosecutor's office promises positive changes in the case of Ogtay Gyulalyev
Baku/19.09.20/Turan: On September 19, the prosecutor of the Nasimi district Hasan Khanifaev received the legal representatives of the family of human rights defender Ogtay Gyulalyev: lawyer Fuad Agayev and director of the Turan news agency Mehman Aliyev.
During the meeting, they exchanged views on the course of the investigation and the procedure for transferring the materials of the criminal case to the court, on which the wife of the victim Firuza Gyulalyeva insists.
The prosecutor assured that at the beginning of next week there will be positive decisions in this direction.
Representatives of Gyulalyev's interests noted that they made their appeals in an official written form, but so far, they received answers only orally and invited them to provide answers in the form established by law.
On September 18, M. Aliyev sent a letter No. 489 to the Prosecutor General Kamran Aliyev with a request to take immediate measures to satisfy all the petitions of the lawyer F. Agayev, as well as to speed up the transfer of the investigation materials to the court for further consideration. The letter noted that after almost 11 months, the case was never brought to court, despite the appeals and demands of the Gyulalyev family and defense. On July 4, 2020, Gyulalyev's lawyer Fuad Agayev and I were received by the prosecutor Hasan Khanifaev.
At the meeting, they were informed about the progress of the investigation and the latest actions of the prosecutor's office. In particular, instructions were given to the investigative body - the Investigative Department of the Nasimi District Police Department to satisfy most of the requirements contained in the petition of the representative of Gyulalyev.
The fact is that despite Fuad Agayev's repeated appeals to the investigation and prosecution authorities, since the end of 2019, he still has not received any answers to them, although the named authorities were obliged to notify him as soon as possible of the results of the consideration of his application and complaints.
At a meeting on July 4, prosecutor G. Khanifaev assured that the investigation was interested in a full restoration of what had happened, and a fair trial.
In the interests of the investigation, the prosecutor instructed the officers in charge of Gyulalyev's case to continue to ensure close communication with representatives of the victim. However, more than two months have passed, and the lawyer has not received formal responses to the petitions.
Human rights defender Oktay Gyulalyev was hit by a car at a pedestrian crossing in central Baku on October 29, 2019. He suffered a head injury, as a result of which he is still in a coma.
On the fact, a criminal case was initiated against the driver Kanan Abdullayev, who knocked Gyulalyev down, under Article 263.1.1 (violation of traffic rules and operation of vehicles, which, through negligence, entailed serious harm to the health of the victim).
Ogtay Gyulalyev has been undergoing treatment at the American Hospital in Istanbul since the end of last year with the assistance of the Heydar Aliyev Foundation. — 0—

According to the Turkish newspaper Sabah, officials from the Istanbul Prosecutor's Office's Anti-Smuggling Unit have detained an Azerbaijani citizen with a large shipment of gold. The detention took place near the Vadi İstanbul shopping center in the Sarıyer district, where a taxi was stopped. During the search, 70 kg of gold was found. The Azerbaijani citizen in the vehicle claimed ownership of the cargo and also stated that he was a diplomat. The investigation by the prosecutor's office is ongoing, reports Sabah newspaper. The media outlet does not disclose the name of the "diplomat," only his initials – M.G.Ş. The Azerbaijani Ministry of Foreign Affairs has declined to comment on the situation.
