Fuad Agayev: Baku deliberately conflicts with European Court
In the case of Ilgar Mamedov, the leader of REAL Movement, the government of Azerbaijan is deliberately confronting with the European Court of Human Rights, said the lawyer Fuad Agayev in his interview with "Objective TV."
The execution of decisions of highest court in Strasbourg I compulsory for every member of the Council of Europe. Earlier, the European Court has made decisions against the government of Azerbaijan in the cases of Farhad and Rafiq Aliyevs, and Akif Muradverdiyev.
In those cases the European Court found that the actions of the Baku Themis are contrary to Articles 5 (right to liberty), 6 (2) (presumption of innocence), 13 (right to an effective protection), 14 (prohibition of discrimination) and 18 (limits the use restrictions on rights) of the Convention for the Protection of Human Rights and Fundamental Freedoms.
As for the charges against Ilgar Mamedov, they are absurd, because he is accused of actions he did not commit, the lawyer said. Thus, the riots in Ismayıllı region began on 23 January, and Mamedov arrived there the next day to talk to the local people.
First, he was charged under Article 233 (public nuisance) and 315.2 (resisting police with force that threatens the life and health), and now the General Prosecutor's Office and the Court of Serious Crimes has aggravated the circumstances. According to them, Mamedov almost single-handedly, organized and provoked a mass protest in Ismailly.
It is noteworthy that the European Court of Human Rights has started before-time communication in the case of Mamedov ( on April 9 this year.) The highest court has sent a number of questions on the case to the government of Azerbaijan. Baku should respond till June 18.
A complaint to the European Court was filed by lawyers in February due to the numerous and serious violations of Ilgar Mamedov’srighst, Agayev said.
Ilgar Mamedov has recognized as a promising figure by political and international circles. he has gained a political weight, and has a good team of experts in law, economics, and international relations. By arresting Mamedov on the eve of the presidential elections, the authorities have decided to get rid of a serious opponent, the lawyer believes. --17D—
