Amendments to the law on combating extremism are unconstitutional, expert

The draft law "On the fight against religious extremism" adopted by the Parliament in the first reading has a lot of uncertainties, the lawyer Alasgar Mammadli.

Commenting on the bill discussed in parliament he said that from now damage to health, life and property of extremists is allowed. Member of operations against religious extremism is not responsible for damage during special operation.

"Thus, the conditions are created to cause damage to human life and property, and without warning,"  said Mammadli.  The bill should  note that the weapons could be used only in case of self-defense and conflict prevention with the condition.

The document  has no clear definition of religious extremism and radicalism. In addition, the law should specify who gives a legal assessment of a specific operation, because the talk is about  the limitation of constitutional rights - human life and damage to property, "  said Alasgar Mammadli.

He also noted that the bill involves the prohibition of religious ceremonies  by persons studying abroad. "After the law came into force, the head and deputy chief of the Caucasus Muslims Department  will not be able to control religious ceremonies  as Allahshukur Pashazadeh and his assistants studied abroad.

This is not a legal approach, because education is not related to extremism or radicalism. It requires an individual personal approach," said Mammadli.

According to the law "On citizenship"  persons involved in the terror and the violent overthrow of the constitutional order may be deprived of citizenship.

  Persons receiving military training under the guise of studying abroad, spreading harmful religious groups involved in religious conflicts abroad and attracting  others to do so will also be deprived of  citizenship.

"Under the Constitution, no one can deprive a citizen of Azerbaijan his citizenship. The law  has no the  concept of the loss of citizenship. According to the 53rd Article of the Constitution of Azerbaijan, under any circumstances, an Azerbaijani citizen cannot be deprived of his citizenship under any  circumstances, cannot be  expelled or transferred to foreign countries. For this reason,  prior to the adoption of these amendments  the conclusion of the Constitutional Court is required. The logic of these changes and amendments  is not clear," concluded Alasgar Mammadli. -03B04-
