Three Soldiers Accused of Soldier Abilov�s Death Arrested
Baku / 17.08.18 / Turan: Three servicemen have been arrested in the criminal case in connection with the death of a soldier of the N military unit of the Azerbaijani Defense Ministry Fahmin Abilov. This is stated in the message of the Military Prosecutor's Office, circulated on Friday.
According to the same source, August 8, 2018, from the N military unit of the Ministry of Defense, the Garabag military prosecutor's office received information that the soldier of this unit Fahmin Abilov committed suicide, firing at himself from a submachine gun. A criminal case was opened in the Garabag Military Prosecutor's Office under Article 125 (bringing to suicide) of the Criminal Code of Azerbaijan.
In connection with the doubts arisen at the parents and close relatives of the deceased about the objectivity of the survey conducted by the Center for Forensic Medical Examination and Pathological Anatomy, the investigation was taken under special control by the leadership of the General Prosecutor's Office. The leadership of the investigation was entrusted to the deputy military prosecutor.
On August 9, in the Association of Forensic Medical Examination and Pathological Anatomy of the Ministry of Health, experienced experts conducted a second investigation of the body of the deceased.
The preliminary investigation found that during the service of soldiers, Abilov was repeatedly subjected to violent and illegal actions by ensign Khalilov Elmir Rasul Oglu and the soldiers of this post, Tanriverdiyev Sanan Sabuhi Oglu and Arazov Rashad Khagani Oglu.
During the investigation it was revealed that on August 8 at 11:45 the on-duty soldier Tanriverdiyev left the place of service ahead of time, leaving the weapon. Taking advantage of this, the soldier Abilov took the weapon and committed suicide.
Given the collection of sufficient evidence, the three servicemen were prosecuted as defendants in the case. Soldier Tanriverdiyev was charged under art. 230 (negligent possession of firearms), 332.2.1 (violation of the statutory relations between servicemen in the absence of subordination relations between them, associated with the humiliation of the honor and dignity of the victim or with the use of violence against him, committed repeatedly), 332.2.3 (the same actions, committed by a group of persons, by prior agreement or in an organized group), 338.1 (violation of the rules for carrying out alert duty) and 341 (abuse of authority or official duty by a superior or official, excess of authority or service powers, deliberate inactivity of authority), soldier Arazov - under articles 332.2.1 and 332.2.3, and ensign Khalilov - under articles 331.2 (insulting of a subordinate by the boss) and 341.
In their relation, a measure of restraint in the form of arrest was chosen by a court decision. -06D--
