Court of Appeal Leaves Blogger Namig Sadigli in Custody
Baku / 20.12.17 / Turan: On December 19, the Baku Court of Appeal dismissed the complaint of the activist of the Popular Front Party of Azerbaijan (PFPA), blogger Namig Sadigli, while keeping in force the decision on his administrative arrest for 30 days.
He was detained on November 30. On December 1, by a court decision, he was arrested for 30 days under Article 535.1 of the Administrative Code of Azerbaijan (non-compliance with the lawful requirements of a police representative).
The consideration of the appeal against Sadigli"s arrest was unreasonably and illegally dragged on for 12 days, the lawyer Asabali Mustafayev told Turan.
Only on the next day after the lawyer"s appeal to the Ombudsman on December 18, the Baku Court of Appeal considered the complaint. The delay was motivated by the fact that the complaint from the first instance court was received only on December 19.
According to the lawyer, the proceedings were formal.
"We put forward a number of motions. We asked in particular to interrogate additional witnesses, to view the video surveillance cameras in the building where Sadigli"s apartment is rented. The police claim that he behaved "suspiciously, and when he was required to present the due documents, he did not obey the police." However, there are witnesses who would confirm that there was nothing like this. In fact, police officers demanded the superintendent of the building tell Sadigli to come down, otherwise he would be taken directly from the apartment, in front of his family members. But the court refused to question additional witnesses," said the lawyer.
In the appeal, the defense also raised the issue of violation of the rights of the blogger under Articles 5 (right to freedom), 6 (right to fair trial), 10 (freedom of expression), 14 (prohibition of discrimination) and 18 (limits on the use of restrictions on rights) of the European Convention on Human Rights.
However, the court rejected both the motions and the appeal itself.
The lawyer noted that the defense will prepare a complaint to the European Court of Human Rights. -06D--
