Elvin Abdullayev is not released on parole
Baku / 22.09.16 / Turan: Today theappeal of the member of the youth committee of PPFA, Elvin Abdullayev on parole has been considered, said a lawyer Fakhraddin Mehdiyev. According to him, Garadagh Court investigated on the event in jail №14, where Abdullayev is serving his sentence, and did not grant the defense motion. The lawyer intends to appeal against this decision.
Elvin Abdullayev was arrested in 2015. He was charged under Article 234.4.3 (a large scale drug trafficking.) In January 2015, the Baku Serious Crimes Court sentenced him to six years in prison. Subsequently, the Supreme Court re-qualified charge on the softer Article 234.1 (use of drugs for personal use.) The sentence was reduced from six years to two and a half years. Due to the replacement of punishment Elvin Abdullayev was transferred from prison №6 to jail №14.
The lawyer noted that the convicted under this Article has served most of the term, can be released prematurely. “We have done it as the "judicial review. Half of term of two years and six months is one year and three months. After that, a prisoner may be released from prison. Elvin also has been in custody already one year and eight months," said the lawyer. According to him, the court explained its decision by saying that the head of jail №14 gave a negative opinion on Abdullayev. -05B--
