European Court Starts Communication in Cases of 25 NGOs in Azerbaijan

The European Court of Human Rights has started communication in cases of 25 NGOs of Azerbaijan in connection with the violation of freedom of association. The lawyer Intigam Aliyev told Turan.

ECHR gave time to the Azerbaijani government till February 6, 2017 to answer all the questions raised by the Strasbourg Court.

In 21 cases the legal representative is Intigam Aliyev, in 2 - Yashar Agazadeh, in one - Azer Naghiyev and in one - Fariz Namazly.

The petition raises the issue of the violation of the applicants' rights under articles 6 (right to a fair trial), 11 (freedom of association) of the European Convention on Human Rights.

In cases that Intigam Aliyev leads a question of violation of Article 34 (right of individual petition) is also raised. Thus, the withdrawal of documents from the office of Intigam Aliyev, including materials on cases in the ECHR, in August 2014 became an obstacle to the realization of the right to appeal.

Among the applicants there are known representatives of media and civil society - Mehman Aliyev, Metanat Azizova, Elchin Abdullayev, Rovshan Mahmudov, Azad Isazadeh, Mehriban Vazir, Khalid Kazimov, Samir Ismayilov, and others.

The complaints are related to the Justice Ministry's refusal to register NGO under the pretext of "deficiencies" in the founding documents. The Ministry of Justice repeatedly returned the documents and the complaints are not investigated.

The ECHR has issued six decisions on violation of freedom of association in Azerbaijan. Four of them are connected with the refusal to register NGOs, and two – with the cancellation of registration.

In cases involving the denial of registration of NGOs, there is a case of the Forum of Lawyers of Azerbaijan founded by the prominent lawyers Eyyub Kerimov, Vidadi Mirkamal, Namizad Safarov, Alovsat Aliyev, Rashid Hajili and others.

In 10 cases the communication has been completed or is being finished, including the case of the Center for Election Monitoring and Democracy Training founded by the former political prisoners Anar Mammadli and Bashir Suleymanli.

In the reports of international organizations, Azerbaijan is among the countries where freedom of association is violated most. -06B--
