No One Punished for Murder of Elshad Babayev
Simuzar Babayeva, sister of Elshad Babayev, who died in Prison No 14, on January 29 was received by the first Deputy Prosecutor Rustam Usubov. The meeting was attended by the Head of Department for Supervision Investigation of the Attorney General Nazim Abbasov, Deputy Prosecutor of Baku Azer Asgarov and Garadagh District Prosecutor's Office investigator Ayyub Bashir. Usubov said that a criminal case was initiated on the fact under article 309.1 (abuse of power). However Babayeva expressed disagreement and said that the investigation should be carried out under Articles "incitement to murder" or "premeditated murder", as signs of violence and torture on the body of the deceased are obvious.
"I also asked why they did not question the lawyer Gurban Mammadov released from the same jail, who spoke to the media about my brother's death and the subsequent protests of the prisoners there. After that, Usubov gave instructions," said Babayeva.
According to her, in Jail No 14 no staff was prosecuted or even suspended from work. According to information from other prisoners, among those who used violence against her brother, are the employees Faig and Firdovsi, but they continue to work.
"Today, 40 days have passed since the death of my brother. I'm not going to back down and will seek punishment of the murderers," said Babayeva.
She also does not agree with the conclusion of the medical examination, which believes that her brother died of cardiomyopathy. "That's not true, my brother never had a heart disease," said Babayeva. She noted that her brother was put in solitary confinement and severely beaten on December 13. Torture continued on the following days, and the prisoner was not allowed to eat or to call the doctor.
Recall that the death of Babayev caused protests of the prisoners and the unrest was suppressed with the use of special force. -06B-
