The HRC appealed again appealed to the Ministry of Justice for registration
Baku / 07.11.19 / Turan: The Human Rights Club (HRC) again applied to the Ministry of Justice for state registration of this public association, reported the co-founder and head of the HRC, Rasul Jafarov.
The organization was created in 2010 and applied for registration with the Ministry of Justice several times, but each time it was refused.
After another refusal in 2011, the HRC decided to appeal the actions of the Ministry of Justice in a judicial proceeding.
However, the national courts did not satisfy the organization’s complaint, and she appealed to the ECHR.
On July 25, 2019, the ECHR invalidated the decision of the Ministry of Justice on the refusal of the HRC to register, finding it a violation of Article 11 (freedom of assembly and association) of the European Convention.
On October 25, this decision entered into force as the government did not file a complaint with the Grand Chamber of the Strasbourg Court.
“Taking into account entry into force of the decision of the European Court, as well as the organization’s commitment to the principles of transparency and accountability, we decided to re-apply to the Ministry of Justice to register the Human Rights Club. We hope that the Ministry of Justice will make a positive decision. This would also be in line with the government’s stated policy of reform. The registration of the Human Rights Club and other NGOs would contribute to the successful implementation of the reforms, because civil society institutions can play an important role in supporting reforms,” Jafarov said. –06B--
