Ali Insanov sues against the Ministry of Justice
The convicted ex-Minister of Health, Ali Insanov, filed a lawsuit against the Ministry of Justice due to bad conditions in jail. The claim was presented to the Baku Administrative Economic Court of N 1, according to his lawyer Togrul Babayev.
He noted that the decision of the European Court of Human Rights in the case of Insanov, which came into force on June 14, 2013, stated that the rights of the ex-minister, guaranteed by the European Convention on Human Rights, have been violated by keeping him for a long time in bad conditions. Insanov is kept in the barracks with additional 128 people. There is only 1.76 square meters per a person, although according to the European Prison Rules, there should be seven square meters.
In addition, the room in which Insanov is kept is raw and not light. Insanov demanded to place him in a cell, which meets the European standards. Earlier Insanov filed suit against the head of the Supreme Court, Ramiz Rzayev, and Plenipotentiary of Azerbaijan to the European Court of Human Rights ( ECHR) Chingiz Askerov. The complaint tells about not fulfilling the decisions of the ECHR, which came into force on 14 June, 2013, and considers invalid the verdicts of the Azerbaijani courts in the case of Insanov. In addition, Insanov filed a complaint with the Committee of Ministers of the Council of Europe due to not following the European Court's decision by the Government of Azerbaijan in his case.
According to the lawyer , the plenum of the Supreme Court was to eliminate the conviction against Insanov, and release him in accordance with the decision of the Strasbourg Court.
On March 14, 2013, the European Court of Human Rights, granted the petition Insanov on the right to a fair trial, and confirmed the fact of his torture. For this reason, the European Court ruled that the government of Azerbaijan should pay Insanov a compensation of 10,000 euros.
Insanov was arrested in October 2005, and charged with preparing a coup, but later the charge was changed, and he was sentenced to 11 years for economic crimes.—06B-
