Journalist's Lawyer Declares Pressure Exerted by Judge
Baku / 20.08.17 / Turan: The lawyer Elchin Sadigov stated about the violation of the rights of his client Elchin Ismayilli. In particular, the preparatory court hearing on Ismayilli's case was held in the Sheki Grave Crimes Court on August 15 secretly from the lawyer.
On the morning of August 15, Sadigov was telephoned from the Sheki Grave Crimes Court and told that the preparatory meeting was scheduled for 4:00 pm on the same day. Although, by law, the lawyer should be notified of the time of the preparatory meeting at least 7 days before the appointed date.
The lawyer asked to postpone the meeting and immediately sent a telegram to the court with a similar request, Sadigov told Turan IA.
On August 18 Sadigov went to Sheki, but in court he was not allowed to meet with Elchin Ismayilli. At the same time, he learned that on August 15 the preparatory meeting still took place. The lawyer believes the judge Rashid Huseynov violated the law.
"This is a violation of the law. The judge Rashid Huseynov himself knows that this is a violation of the law. Therefore, on August 18, he demanded that I change the date of the warrant, which, like the agreement on legal services was signed on August 1. The judge wants to change the date of the order to hide his illegal action," Sadigov said.
According to him, holding a meeting without a lawyer and not giving the defender the opportunity to meet with the accused is a violation of the law. Sadigov said he would apply to the Judicial-Legal Council and the General Prosecutor's Office to investigate the actions of the judge.
The next hearing in the Ismayilli case is scheduled for August 24.
Recall that an independent journalist Elchin Ismayilli was arrested on February 17. He was charged under articles 182 (extortion of money by threats) and 308 (abuse of office) of the Criminal Code. In early August, he was charged with another accusation under art. 311 (receiving a bribe). On these charges, he faces 8 to 12 years of imprisonment.
According to the accusation, the journalist extorted money from an employee of the department of culture and tourism. The latter applied to the Ministry of National Security, whose employees arrested the journalist.
According to the lawyer, the case was falsified and the journalist was arrested for his professional activities. "Elchin and the above-mentioned employee of the culture department have long known each other, and the journalist asked him for a money debt amounting to 1,000 manats. When the journalist received the money, he was arrested," the lawyer said. -06D-
