The verdict against Fuad Ahmadli is politically motivated, human rights activist
Baku / 17.06.17 / Turan: The Center for the Protection of Political Prisoners strongly condemned the sentence of imprisonment for 4 years for the People's Front Party activist Fuad Ahmadli. The human rights organization believes that Ahmadli was arrested and convicted on a political order.
The statement of the Center it is noted that Ahmedli published critical posts in Facebbok against the authorities and corrupt officials, participated in the organization of protest rallies, for which he was repeatedly subjected to administrative arrests. In August 2016 Akhmedli was prosecuted under articles 302.1 (carrying out search activities by persons who do not have the right to do so) and 308.1 (abuse of official powers) of the Criminal Code of Azerbaijan. "Detention, investigation and trial were conducted with gross violations of Azerbaijani legislation and norms of international law.
The witnesses were under pressure. One of the "victims" is in search for a long time on suspicion of committing a crime, but nevertheless, his "written" evidence was recognized as "evidence", and all the lawyer's applications were rejected by the judge, "said the head of the Center, Elshan Hasanov. The court did not provide the principle of a fair trial, which is a violation of Article 6 of the European Convention.
During his detention in jail N1, Ahmedli was repeatedly and without causation put in a punishment cell, Hasanov said.
Akhmadli was imprisoned almost unreasonably for almost a year and, thus, Article 5 of the European Convention - "The Right to Liberty and Personal Security" - was violated against him.
In the remand prison, Ahmadli was deprived of the necessary medical care, despite a serious lung disease. In 2014, he underwent surgery on the lungs and should be under the systematic supervision of doctors. Attorney Asabali Mustafayev submitted a medical report to the court, but it was not taken into account. Therefore, there is reason to speak of a violation and Article 3 of the European Convention (prohibition of torture.)
It should be recalled that on June 16, 2017, the Baku Serious Crimes Court sentenced Ahmedli to 4 years in prison.
