Lawyer Yalchin Imanov Cannot Receive Decision on Termination of His Authority
Baku / 27.01.18 / Turan: The lawyer Yalchin Imanov cannot receive a decision on the termination of his lawyer powers. He has twice appealed to the Presidium of the Bar Association. However, he was given only a short extract from the minutes of the meeting of the Presidium, at which the question was discussed. Turan was informed about this by the lawyer himself.
The lawyer does not know what article of the law justified his punishment. The decision of the Bar Association has to be approved by the court. However, the trial is delayed. The failure to issue the Bar Association's decision limits Imanov's right to appeal to the court himself.
An expert in the field of law, a member of the Civil Society Platform Khalid Agaliyev considers it illegal not to disclose the decision of the Presidium of the Bar in the Imanov case to the public.
"The decision should be issued not only to the applicant, but should be published in a commonly accessible place. This is a requirement of the law On Receiving Information, Agaliyev said.
According to him, the law obliges the Bar to have its own website on the Internet and constantly update it. The Bar's decisions and other documents of public content should be published on the website.
Turan did not manage to receive comments from the Bar.
It should be recalled that on November 20, 2017, the Presidium of the Azerbaijan Bar Association suspended Yalchin Imanov's powers and appealed to the court to exclude him from the Bar. The reason was the appeal of the Penitentiary Service, which accused the lawyer of violating public stability. Imanov also said he was carrying out his professional work, publicizing the facts of torture in prison over his clients. The International Bar Association and the Council of Europe Commissioner for Human Rights condemned the decision to dismiss Imanov. -06D--
