Lawyers Going to Apply for Medical Examination of Intigam Aliyev
The lawyers Elton Guliyev and Javad Javadov the human rights defender Intigam Aliyev in jail in Kurdakhani. Does the health of Aliyev give a basis to change the preventive measure?
In answering this question, the lawyer Guliyev said that unambiguous assessment of the state of health may be given by the doctors. At the same time, he noted that, according to the criminal procedure law, the preventive measure of arrest chosen by the court may be changed or canceled only by the court.
However, under the law in two cases the investigator may terminate the application of the restrictive measure of arrest chosen by the court: in the presence of a medical reference that the accused cannot stay in custody in connection with a serious illness; and the qualification of the offense as crime not representing big public danger. In the case of Aliyev the investigation has not yet shown the intention to soften the accusation. However, there are grounds for the first case.
In connection with this the defense is going to apply for the appointment of a medical examination of the health status of Intigam Aliyev.
Earlier medical examination confirmed the presence of spinal hernia and osteochondrosis at the inmate. However, the medical report was not given to the lawyers.
Recall that Intigam Aliyev was arrested Aug. 8 on charges of illegal business, tax evasion and abuse of office. He denied all the charges. Amnesty International acknowledged Aliyev "prisoner of conscience». -06D-
