Appeal will be filed against the sentence in the case of the member of NIDA movement, Civil Solidarity Party, and facebook activist Omar Mamedov, said Khalid Bagirov, the lawyer of the accused. Mamedov’s guilt was not proved, and the verdict itself is a political order. This is how a lawyer regarded a sentence Baku Serious Crimes which convicted Mamedov to five years of imprisonment for drug trafficking. In his closing remarks, Mamedov said he did not accept the charges and pleaded not guilty.
The reason for his arrest is creation of pages on facebook: “Lists of AzTV” and "Heydar Aliyev", sharply criticizing the government. Within a short period, this page has become popular; as a result of exchange between users the number of viewers reached from 30,000 to 60,000. According to the administration of the facebook, last month the page "Lists of AzTV" was viewed by about 500,000 users.
According to Mammadov, on November 22, 2013 his father was summoned to the Chief Directorate for Combating Organized Crime (CDCOC) of the Ministry of Internal Affairs, demanding to stop the curse of the authorities. At that time Mamedov was studying in Turkish Cyprus, and told the representative of the CDCOC who called him to release his father, and that he himself would soon return.
On January 20, 2014 Mamedov returned in Baku, and the next morning he and his father were taken to the CDCOC.
" I knew that I will be arrested, but I returned to Baku, and do not regret it," said Mamedov.
From the beginning he did not believe in the fairness of the trial, and trial for him was an opportunity to meet with family and friends. " It is an idiocy to expect a fair trial in a country where there is no rule of law," Mammadov said, recalling Article 295 of the Criminal Code, which for the intentional imposition of wrongful conviction is punishable by imprisonment for three years.
"I especially reminded of this article. For every unjust decision in the future you will be punished. Neither you nor your leaders can not avoid it," Mammadov said, referring to the judges and prosecutor.
He further cited the French revolutionary of the 18th century, Gracchus Babeuf: "Foulon was executed by a sentence of the people. Oh, how it hurts me to see the delight of the crowd! I was satisfied and dissatisfied. Our rulers, instead of making us civil, turned into barbarians, for themselves they are as follows … "
"Aliyev regime believes that filling prisons with free-fighting youth, it eliminates the threat to his power. However, unwittingly they make heroes of this young. We are citizens of the country where 140 political prisoners. Half of prisoners in Europe is in Azerbaijan," said Mamedov. "The most important thing for person is the judgment of his conscience. There's no false witnesses, nor fabricated lawsuits. I My conscience is clean, and that is enough for me," summed Mamedov.
When the judge Eldar Mikayilov asks whether he wants to ask court about something, the young man said, "Read out the sentence that they ordered you." The relatives and associates of Mamedov in the hall met Mamedov’s words with an ovation. The court retired to consider, and then verdict was announced.
However, it is not clear how the judges managed to write with 30minutes a multi-page text that was read for 50 minutes?
The PFPA leader Ali Kerimli who was watching the trial said about the verdict: " It was once again confirmed that prosecutors and courts are tools for government repression." Political prisoners in Azerbaijan have long ceased to be an internal affair of the country, and now this problem attracted the attention of the whole world. Kerimli expressed a confidence that with the joint efforts of the local and international community it will be able to release political prisoners. –0616D-
