What Is Legal Mechanism for Dissolution of Parliament? (UPDATED)
Baku / 28.11.19 / Turan: The legal norm on the dissolution of parliament was introduced by the Constitution referendum in 2016.
This is reflected in article 98-1 “Dissolution of the Milli Majlis of the Republic of Azerbaijan”.
According to this norm, if the same convocation of the Milli Majlis of the Republic of Azerbaijan twice during a year expresses no confidence in the Cabinet of Ministers of the Republic of Azerbaijan or fails to appoint the necessary number of candidates for collegial activity of the Constitutional Court, Supreme Court, and the Board of the Central Bank of the Azerbaijan Republic, as well as for fatal reasons, does not fulfill its obligations specified in Articles 94 and 95, parts II, III, IV and V of Article 9 6, article 97 of the Constitution (these norms are connected with the non-fulfillment of legislative functions by the parliament), the head of state dissolves the Milli Majlis.
According to the law expert Alesker Mammadli, in the current situation, a situation will most likely be artificially created when the parliament will not be able to function.
For the legitimacy of the meetings of the Milli Majlis, participation of at least 83 deputies is necessary.
Given that about 70 mandates in the parliament belong to the New Azerbaijan Party and they will resign en masse, the parliament will in fact not be able to fulfill its duties. After that, the President will decide on the dissolution of parliament and on the calling of early elections.
An extraordinary election date must be set at least 60 days before the vote. But taking into account the fact that a certain time is still needed to prepare the elections, they are likely to be scheduled for February-March 2019.
It should be noted that currently there are 118 deputies in the Milli Majlis, of which 70 are members of the New Azerbaijan Party.
Today at 14.00 a meeting of deputies from the NAP is scheduled, which is likely to take a decision on the rejection of their deputy mandates. —06D-

Ruling Party of Azerbaijan Proposes to Dissolve Parliament
Baku / 28.11.19 / Turan: The ruling New Azerbaijan Party proposes to dissolve the Milli Majlis. Such a decision was made at today's emergency meeting of the party. The decision adopted said that this proposal was caused by the need to support the reforms initiated in the country and the change of personnel.
At 15 o’clock, a press conference on this topic will be held at NAP. NAP Deputy Executive Secretary Siyavush Novruzov declined to comment on this decision. “You will learn about everything at the press conference,” he told Turan.
Member of Parliament Vahid Ahmedov said the decision would be discussed at tomorrow’s meeting of the Milli Majlis. -02B-

The European Court of Human Rights (ECHR) today issued five rulings on applications from Azerbaijan. The case of "Afgan Mammadov v. Azerbaijan" concerned the complainant's exclusion from the Bar Association. Mammadov was expelled based on a complaint filed by a colleague, which he considered unjust. The ECHR ruled that Mammadov's rights had been violated and ordered Azerbaijan to pay him €5,000 in compensation for moral damage and €1,000 to cover legal costs.
