N.Safarov: "electronic court" is not a panacea

The main problem of the judiciary in Azerbaijan is the dependence of the judiciary on the executive. This problem can not be solved by creating "electronic courts," said in an interview with Turan a member of the National Council of Democratic Forces (NCDF), lawyer Namizad Safarov, commenting on the presidential decree on the establishment of the "E- trial."

In his view, "any electronic systems, or even by conducting show trials, the problem of providing justice  of courts cannot be solved." "The fact is that the judges depend on the executive power. Unless a real power split is not provided in Azerbaijan, it will be impossible to provide independence of courts,"  Safarov said.

According to the expert in the field of law, Alaskar Mammadov, Azerbaijani courts problems can be divided into two groups - the adoption of unfair decisions and breach of unfair decisions and bureaucratic red tape.

Thus, according to him, it is a common practice, when judges do not inform their citizens about the adopted decisions, and promise to announce them "later", and it  lasts for weeks and months. In addition, citizens can not get for  a long time in the courts the decision.  Consideration of cases is also unreasonably long and protracted.

In this sense , according to Mammadov, the introduction of "electronic court" can contribute to solving the problems associated with the violation of procedural rules, red tape, and enhance the transparency of  courts. -06B-
